1. Introduction

Welcome to Sana ("Platform", "we", "us", "our"). This Platform is owned and operated by Paul Rivera Rada. By accessing or using our Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Platform Description

The Platform provides an online marketplace connecting individuals seeking therapy ("Seekers") with licensed mental health professionals ("Therapists"). We facilitate these connections by allowing Seekers to post anonymous therapy requests and enabling licensed Therapists to view and respond to these posts.

3. Role of the Platform

3.1. We are NOT a Healthcare Provider

  • The Platform is solely a matching service
  • We do not provide therapy, counseling, or any medical services
  • We do not endorse any specific Therapist
  • We are not responsible for the quality or appropriateness of any therapy services

3.2. Platform Limitations

  • We do not verify the accuracy of Seeker posts
  • While we verify basic licensing information, Therapists are responsible for ensuring their compliance with all applicable laws and regulations
  • We do not guarantee matches or successful therapeutic relationships

4. User Accounts and Eligibility

4.1. Seeker Accounts

  • Must be 18 years or older
  • Must be seeking therapy services for themselves OR be the legal guardian of the individual seeking therapy
  • If posting as a guardian:
    • Must have legal authority to seek therapy services for the dependent
    • Must explicitly indicate guardian status when posting
    • Must provide accurate information about both guardian and dependent
    • Accepts responsibility for all interactions on behalf of the dependent
  • Must provide accurate location information for licensing compliance
  • May remain anonymous to other users while maintaining a verified account with us

4.2. Therapist Accounts

  • Must be licensed mental health professionals in good standing
  • Must provide and maintain current licensing information
  • Must only respond to Seekers in states/jurisdictions where they are licensed
  • Must maintain professional liability insurance
  • Must pay applicable Platform fees

5. User Conduct

Users agree not to:

  • Provide false or misleading information
  • Harass or harm other users
  • Circumvent Platform fees
  • Share personal information outside Platform guidelines
  • Use the Platform for any illegal purpose
  • Attempt to access other users' data
  • Create multiple accounts

6. Privacy and Confidentiality

6.1. Data Protection

  • We implement reasonable security measures
  • We collect and store only necessary information
  • We do not sell personal data

6.2. HIPAA Compliance

  • While we implement HIPAA-compliant security measures, we are not a HIPAA-covered entity
  • Therapists are responsible for their own HIPAA compliance

7. Fees and Payment

7.1. Therapist Fees

  • Subscription fees for accessing Seeker posts
  • Payment processing fees
  • No refunds for completed viewing periods
  • We reserve the right to modify fees with notice

7.2. Seeker Fees

  • Currently free for Seekers
  • We reserve the right to implement Seeker fees with notice

8. Intellectual Property

  • Platform content and features are our property
  • Users retain rights to their own content
  • Limited license granted for Platform use

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

10.1. Cap on Liability

  • Our maximum liability is limited to fees paid to us in the prior 12 months
  • We are not liable for indirect, consequential, or special damages

10.2. No Liability For

  • Quality of therapy services
  • Accuracy of user information
  • User disputes
  • Technical interruptions
  • Third-party actions

11. Indemnification

Users agree to indemnify and hold us harmless from any claims arising from:

  • Their use of the Platform
  • Their violation of these Terms
  • Their interaction with other users
  • Their provision or receipt of therapy services

12. Dispute Resolution

12.1. Informal Resolution

  • Parties will attempt to resolve disputes informally
  • 30-day cooling-off period

12.2. Binding Arbitration

  • All disputes subject to binding arbitration
